Dominion Digital offers digital marketing, web design, AI automation, and related services to small and mid-sized businesses. Specific deliverables, fees, and timelines for any engagement are set out in a separate written service agreement signed by both parties.

3. SMS communications

We operate SMS messaging programs to communicate with prospects and customers. By calling or texting one of our business phone numbers (including 816-203-0903), you consent to receive SMS replies from us about the inquiry you initiated. Message frequency varies. Message and data rates may apply.

You may opt out at any time by replying STOP. Reply HELP for assistance. We do not send unsolicited marketing SMS to consumers and do not share your phone number with third parties for their marketing purposes.

4. Acceptable use

You agree not to use our website or services to:

• Violate any law or regulation.
• Send spam, harass others, or transmit malicious code.
• Reverse engineer, scrape, or attempt to gain unauthorized access to our systems.

We do not guarantee uninterrupted access, error-free operation, or specific business outcomes from marketing, SEO, or automation services. Results vary based on factors outside our control, including your market, offer, and execution.

7. Limitation of liability

To the maximum extent permitted by law, Dominion Digital's total liability arising out of or related to these Terms, the website, or any service is limited to the fees you have paid us in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater. We are not liable for indirect, incidental, consequential, special, or punitive damages.

These Terms are governed by the laws of the State of Kansas, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Johnson County, Kansas, and you consent to the personal jurisdiction of those courts.
